Does Posted Notice apply to Law Enforcement?

Postby fl0at » Sat Jul 11, 2009 3:18 pm

I'm sure this has been addressed, but after eating lunch today I was reminded of what John said in "Carrying a Handgun for Self Defense in Tennessee 3rd ed" about law enforcement carrying in places that serve alcohol for on premise consumption, pages 37-40.

As they are not currently allowed to carry, what about after July 14th? Will the officers who were previously disallowed to carry now be allowed to carry, even if the location posts notice, or will the posted notice apply to the officers who dine on/off duty, or does TCA 39-17-1350 still apply, even after July 14th?

Thanks in advance,

Kelso

The legislators passed a special bill just for law enforcement. It is not part of the lawsuit, so even if permit holders are stopped by the courts, off duty officers will not be.

Besides, no one is telling the police that they are intentionally violating the law.

I dont see leo's as a special class of people and i dont agree they should be allowed carry where the law abiding citizen is not.they slipped that one through perhaps because they believed the citizens would be appeased by the passage of the restaurant carry, however it still creates an elite class, in essence above the law.It should apply to them but now it doesn't ,I'm sure serpas , is happy, that name sounds a lot like serpent.

I may be misspeaking here, and correct me if I am wrong, but wasn't there an argument presented in the TN Senate that basically said that everyday ordinary citizens should be able to protect themselves from misaligned individuals, whether law enforcement or not? I think is was a reference to the Wind Jammer incident, but not entirely sure.

But with the passage of a separate bill that will not forbid off duty police officers from entering a place with a posted notice banning weapons, doesn't that once again limit the scope of that argument?

What was the logic behind such a move, because if a restaurant posts notice and the everyday customer cannot carry, but an off duty officer can, what was the purpose of that argument?

And restaurant owners wonder why many of us won't visit their establishment again if they post notice....

I did point this out to one local restaurant here, telling them that they have been serving lunch to law enforcement for years without a problem, even though they were breaking the law, but after July 14th, I, law abiding, am not allowed to eat lunch?

Oh well, thanks for the reply Mr. Harris.

Democracy is two wolves and a lamb voting on what to have for dinner.
Liberty is a well-armed lamb, contesting the vote.
