HB0962 (restaurant carry) passes the House on a vote of 70 to 26 with the curfew provision still burdening it.

Now its time to try and kill that curfew in the SENATE!

Here is the vote detail on the bill in the House on April 6, 2009:

Representatives voting aye were: Barker, Bass, Bell, Borchert, Brooks H, Brooks K, Campfield, Carr, Casada, Cobb C, Cobb T, Coleman, Coley, Curtiss, Dean, Dennis, Dunn, Eldridge, Evans, Faulkner, Ferguson, Fincher, Floyd, Ford, Fraley, Hackworth, Halford, Harrison, Hawk, Haynes, Hensley, Hill, Johnson C, Johnson P, Kelsey, Litz, Lollar, Lundberg, Lynn, Maddox, Maggart, Matheny, Matlock, McCord, McCormick, McDaniel, McDonald, McManus, Montgomery, Moore, Mumpower, Niceley, Odom, Ramsey, Rich, Roach, Rowland, Sargent, Shepard, Shipley, Swafford, Tidwell, Tindell, Todd, Watson, Weaver, Windle, Winningham, Yokley, Mr. Speaker Williams -- 70.

Representatives voting no were: Armstrong, Bone, Brown, Camper, Cobb J, Cooper, DeBerry J, DeBerry L, Favors, Gilmore, Hardaway, Harmon, Harwell, Jones S, Jones U, Kernell, Miller, Naifeh, Pitts, Richardson, Shaw, Sontany, Stewart, Towns, Turner L, Turner M -- 26.

Note that the NO votes were predominately if not almost entirely urban Democrats with heavy vote unity from Memphis. Almost 1/2 of the state House Democrat caucus voted AGAINST the bill whereas all but one of the House Republicans voted for it. I want to stress that this is not and should not be a party line issue but 2nd Amendment issues continue to have strong resistance from significant numbers of the House Democrat party.

Sadly, one of the disappointing surprises here is Beth Harwell voting against the bill. It is important to know that Rep. Harwell has been discussed as a possible contender for House Speaker and voting against one of these bedrock 2nd Amendment issues is not a good sign.

Am I reading this correctly? We'll be able to carry in restaurants that sell alcohol, but will no longer be allowed to carry between the hours of 11pm and 5am to these places, or does that mean we'll no longer be allowed to carry between those hours anywhere period?

The curfew, which with enough calls to the legislators from TFA and NRA members we hope to strip off the legislation, would only apply if it passes to restaurants that serve alcohol or beer.

Also, one correction.

Two house Republicans voted No. Harwell, and Cobb J. Of the three Cobbs he is the only Republican, and he is a POS in my opinion. He doesn't talk or care about a chunk of his constituents, and has never returned any e-mails I have sent, even when asking him to be a speaker for the local chapter in the past. The people I know who live in his district are not fond of him, and sadly won re-election. I expect local republicans will fight him again, as he is pretty much an ass (not my word either, they specifically said he was an ass to them) to them. He did not beat Vincent by much in the primary last year.

Needless to say, I don't really like or respect Jim Cobb.

I understand that we all want a "clean" bill, myself included. But here: http://www.wkrn.com/Global/story.asp?S=10137619, WKRN reports the following:

"The House voted 72-17 to reject an attempt by Rep. Brian Kelsey to remove any time limitations."

I don't like it at all. I fear, however, that if the Senate not only votes for a clean bill in its chambers, but also demands a clean bill in conference; well, the House has already voted their intentions with regard to the matter by a seventy-two to seventeen vote, and the House is sending a clear message to the Senate. The House WILL NOT pass restaurant carry without a curfew.

In my opinion, there it is. We can either accept what the House is, by seventy to twenty-six, willing to give us...or we will once again get nothing this year. One-and-a-half-years is a lifetime in state politics, and goodness only knows how the General Assembly will be constituted in 2011.

I know this will be an unpopular stance here, and I know I will get roasted for it. But this is the best chance we have had in a long time to get such a bill, and the Governor is far more likely to sign a bill that has the curfew than not; since twenty-one members of his party voted for it in the House too, they provide him with political cover. I don't like it, but I'll take half a loaf now--the law-abiding permit holders of this state will by their actions let the voters and legislators know they have nothing to fear, and we can get the other half (no curfew) a few years down the line.

As Roger Sherman said at the Constitutional Convention, "The business of government is compromise. Let's get this infernal business over with."

Falcon,

Previously we have gotten bills with no curfew or age restriction through before. We need to hammer it home that this was good legislation before, and it is good legislation now. I think if given the option of a black mark on voting anti-gun or voting more pro-gun than they expected, we will win.

Also, the NRA is finally helping a bit, with their e-mail alerts. Kind of hard for an elected official to say the NRA blessed his bill when they did not. We should push the Senate hard, and the House as well when it comes time. The votes are there, and if we need to overcome a veto (only a majority of those elected is needed), I think we can do it. Also, unless Bredeson wants to make it harder for Democrats in Tennessee, he will sign it. The party is having enough trouble with Obama making Democrats look like anti-gun socialists. If he gets anti, he loses power, a lot of it.

A simple question, is it of any value to call and write members of the House and Senate that are NOT the respondent's constituent? As I feared and expected, the gentleman that is MY Representative voted against the measure. Is there any value in reaching across district lines?

Has anyone heard why Harwell voted against the bill in the house? I have emailed her repeatedly about supporting the bill but never got a response.

I guess I will have to email her why she decided she doesn't want my vote in the future... and I do live in her district. I will be surprised if I get a response now.
