HB0962 - Restaurants - to meet May 4

Postby johnharris » Thu Apr 30, 2009 3:01 pm

The House voted on April 30 not to accept the Senate bill - for a 2nd time. That triggered the appointment of a conference committee.

The committee meeting is tentatively scheduled on Monday, May 4 at 2:00 PM in LP31.

House Video: Start at 35 minutes

House Conference Members are Todd, McCord, Armstrong, Bass, Casada

Senate Conference Members are: Jackson, Finney, Burchett, Stanley, Beavers

I would strongly recommend phone calls to all conference members. I suspect we don't have to worry about the Senate members but we need to encourage the House members

I will get in touch with Lowe Finney, (my district). What points should I be sure to cover in our conversation? I am sure I can reach him by phone.

The difference in the two bills are that the House wants to
- prohibit possession in any "age restricted" place without regard to time and
- prohibit possession in any restaurant after 11pm

The Senate strips both restrictions

Here are some points
- Age restricted locations came into existence primarily in relation to places where patrons could smoke. While some of these locations may have a "non-family" atmosphere, that does not mean that they should be weapons restricted. The House added in this "age restricted" clause on the theory that these places are primarily bars, night clubs, dance clubs, etc. So, what if the permit holder is with a group and that is where the group wants to go? The no drinking restriction still applies. Part of the problem here is that the bill would apply to normal restaurants that become "age restricted" at any time. Thus, if the restaurant becomes age restricted at say 8pm - permit holders would have to immediately leave.

- 11pm was dreamed up as a response to an initial House proposal, I think by McCord (R.) but I double check the study committee video, to make permit holders leave by 9pm. The real point is - why? For example, we often go out on Friday night after high school football games and by the time the game is over, it can easily be 11pm or later before we get served and leave the restaurant. Why would we need to leave early or even get up and go the car/trucks to store the firearm(s) at 10:59?

Neither of these restrictions have any demographic, statistical, and verifiable data to support them. Its just guesses, suppositions, rumors and, well, made up. Some might think that the fact that its dark or late means only "bad", "reckless", "irresponsible" or "untrustworthy" people are out at that time of night but how do you apply that to 2nd and 3rd shift employees? How do you apply that to the employees of these places? How do you apply the 11pm rule on the time line on the Cumberland plateau?

Its a fear mongering distrust of permit holders pure and simple. They will tell you at election time that they support the 2nd Amendment, that they are permit holders, that they are NRA members well if they are at election time then they need to prove it with their voting records.

I received a phone call from the NRA about this but was a recording and then was cut off in the middle and phone went dead. Did anyone else receive this call?

They have my number - they give it out all the time - but I have not received any calls of this type in a long, long time. Good to know they are trying. However, phone banking can be expensive and I would think there would be better ways to motivate members in TN, but wait, that is one of the reasons we started TFA.

First post as Im new to the site. Have had my permit for two weeks today.
I just remembered the committee was meeting today and just caught the very end of the meeting but it looked like they agreed to adopt the senate version by a vote of 3-2. I dont know why all 10 did not vote. Some one who saw the entire meeting can correct me if Im wrong. Senate mentioned voting again Thursday on the recommendation and the House was gonna try and get it on the floor tonight.

Word is the Conference committee voted to pass the Senate version, i.e., with out the amendments.

Been told all Senators on committee voted to pass it; House represenatives on committee voted 3-2 to pass. Opposing were McCord and Armstrong.

That explains what I caught at the tail end of the meeting. Thanks for the clarification.

What if?

Postby Tim Nunan » Tue May 05, 2009 3:00 pm

Apparently Representative Armstrong is trying to get the House to accept his minority report from the Conference committee. While acceptance of the majority report by the House gets the bill passed what is the result if the House accepts the minority report?

I was hoping for a more legal response.

66 ayes and 23 nayes. Thats GREAT news. I did not think the clean bill would make it through after the votes of the last few weeks.

Now does it go to the Gov or does the Senate need to vote on the conferance com. report?

Looks like it will be law on June 1st 2009 either way.
