Restaurant bill lawsuit thrown out (delayed)

Postby netmindr » Mon Jul 13, 2009 4:51 pm

The judge threw out the lawsuit. Looks like we're legal tomorrow. Admin Note: The news is misreporting the effect of the Chancellor's ruling. The court refused to issue a preliminary injunction. The case remains pending and is anticipated to be back in court for further proceedings in October.

newschannel5.com had a poll today asking "Do you think a judge should stop the guns-in-restaurants bill from going into effect Tuesday, July 14, 2009?" 62% said No.

We had to figure that the lawsuit had no grounds but any time you get a bunch of wealthy lobbyists together on a subject, especially when they represent a group like restaurants and entertainment in a city that depends on tourism, you have to worry about their political power. But its hard to question the constitutionality of a bill that simply gives law abiding citizens rights they are granted by the state constitution.

I overheard Adam Dread say (to someone David Randolph Smith indicated as a "researcher" dressed in jeans and a T-Shirt):

"If our team was Public Enemy, I would be Flavor Flav."

Probably the most accurate assertion to ever come out of his mouth.

I wonder how long it will take the state to edit the laws on Dept of Safety website.

Several times today, I have attempted to post what I saw and heard in the courthouse.

I have edited myself multiple times as it sounded too vendictive or even petty and I will not stoop to their level.

I had a case come before Bonnyman and my attorney had me read the rules of the court.

I reread those this evening and it just made me even more mad.

I watched Rayburn, Dread, and the anti gun crew strut around looking for cameras before the circus began.

I heard pure garbage out of the mouths of Rayburn and the rest about how they were there to protect MY INTEREST as a gun owner.

I overheard one idiot ask another if the pro gun people were armed.

I watched young Gulch Dwellers actually recoil in horror and crinkle their noses as they judged the less fashionably dressed people in attendance.

I heard the frivolous attempts to interject half baked ideas by quoting irrelevant court rulings and quoting Serpas without mentioning that he was practically a lone voice in the LEO field.

I watched the group in my area high five each other as the anti's made one poor point after another.

The jokes stopped when the tone of the complainants went from bolsterous to strained.

The crowd in my courtroom booed the bench as Chancellor made her ruling.

Afterward, I heard jokes about how we'd all go home tonight, sit around our trailers with a beer in one hand and our pistol in the other, practicing for our first "night out in a real restaurant" in years.

I watched restaurant owners sulking through the halls, avoiding strangers and camera.

I know Steve Gill loves to promote Amerigo's on his show. Now he is going to have to chose between his HCP listeners and his cigar buddies in Brentwood.

And don't even think about spending your money at Noshville on Broad.

Sam's Sportsbar in Green Hills is another pass unless you like hanging with Algore's crowd from the Belcourt on a non football night.

Obviously they actually think they are morally superior to us and at the same time want our money.

I could go on but suffice to say what I saw today made me sick of the entire process.

These people are a disgrace to their cause (if they actually have one) and were doing nothing but grandstanding for publicity for upcoming elections.

I overheard conversations about how publicity from this action could be used to go after Sen. Diane Black and Lt. Gov. Ron Ramsey.

I understand now why the judge sits so high up in the courtroom.

It is to keep her above the stink that permeates the room.

From what I saw today, I'd say that the standard attire for attorneys should no longer be suit and tie but chestwaders.

I have a question and a suggestion....

The question...Does a posting still have to contain fairly specific wordage to be a legal posting? The signs they are showing on the news are not and violation would be simply a violation of restaurant policy and not state law. Now, I wouldn't intentionally go to a place that posed but if I drove some distance for dinner and found a sign that said NO GUNS, EVER I think I'd just go ahead and have dinner.

The suggestion...We need to take video cameras to these places and confront the owner. Ask him what he is doing to INSURE that no guns enter his restaurant. Take a look around and note to him that there are no metal detectors. Suggest that it is his responsibility to keep his patrons safe and the public has the right to know how he is doing that. You know they are not checking people at the door, so I would say to the owner "I know for a fact that there is at least one person in this restaurant carrying a gun and I know who that person is. If this person was allowed to enter, how can we as patrons be sure that others have not done the same?

Once you have all that on tape, put it on youtube with the proper keywords and post the url on popular sites where it will get indexed.

It's not just a message to gun owners. Others need to be aware that the restaurant owners are effectively telling criminals that they can rob their establishment with no armed resistance. They need to be aware that these owners are doing nothing to actually prevent a criminal from entering with a gun.

I personally would not carry into a venue that made any attempt to post, regardless of the legality of the effort on the Owners part. A much simpler approach would be to abstain from entry, and giving that business any of your money. If the proprietor does not want my business, I will oblige them.

With money being at even more a premium these days,Its shocking that these people would chance any dollars at the expense of slapping down pesky hcp holders just to put themselves above others and hold high their position of power. What is the force that drives individuals? For most hcp holders that I have spoken with,it is Patriotism, knowing we were given, granted, rights under the constitution and having the willingness to defend those documents and the morals they hold high.,,, I look to the restaurant owners and see grandstanding, I need a news camera,I want to save my customers from harm, blah, blah, blah,,,,, ,,,, whatever.......... If only there were anything at all honorable in what these restaurant owners were saying, but what they hold high, is money, money, and money, and the power that it brings, just because your wealthy it does not mean you are wise, and just because you are poor, does not mean you are not wise. There is one fact that will remain constant for ever. freedom as well as tyranny ,dominance and control have always been won at the tip of the sword and the barrel of the gun. It is the only deterrent to evil,as evil has no ears to hear with. When those who present themselves to be overly concerned with the safety of innocents under the guise of removing firearms from the hands of any and all, then there is treachery, deceit, greed, and evil seeking control over and above ALL!,,, The law abiding have nothing to fear from the law abiding, and everything to fear from the man who seeks his gun.

Well, in general, yes, the more the merrier, but it is a little intimidating the first time you get stopped and have your permit run. Some people just aren't up to being prepared to be hassled by the police for shopping while armed.
