Requires completion of an annual eight-hour firearm training program. Requires a written directive from the head of the postsecondary institution. TFA supports although the law is not well written.



SB 3987
Beavers CRIMINAL LAW: Assault on law enforcement officer. Creates new Class E and Class D felony offenses of assault on law enforcement officer. Also creates offense of aggravated assault on law enforcement officer. Specifies that a violation is a Class B felony. (HOUSE: HB 3991, DuBois; House Judiciary deferred to 03/26/2008.) FISCAL NOTE: Dated: February 28, 2008 Increase state expenditures - $1,403,400/incarceration. Decrease local revenue - Less than $100,000. Decrease local expenditures - exceeds $100,000.

TFA opposes - we already have adequate laws for this. Why should the penalties be greater if there is an attack on a law enforcement as opposed to a private security officer and/or even a permit holder?



SB 2720
Norris CRIMINAL LAW: Handgun carry permits - sheriff's requirements. Removes requirement that the county sheriff in which a handgun carry permit applicant lives provide the department with any information concerning the truthfulness of the applicant's answers about eligibility requirements for such a permit. (HOUSE: HB 3410, Buck; Set for House Judiciary Criminal Practice Subcommittee 03/19/2008.) FISCAL NOTE: Dated: February 4, 2008 Decrease state expenditures - not significant. Decrease local gov't. expenditures - not significant.

SB 3755
Norris CRIMINAL LAW: Confidentiality of handgun carry permit applications. Declares information contained in handgun carry permit applications and renewals, information provided to agencies to investigate applicant, and records maintained relative to the permit application is confidential. Creates Class E felony of unauthorized publication of permit information or records. (HOUSE: HB 3137, Bass; Set for House Judiciary Criminal Practice Subcommittee 03/19/2008.) FISCAL NOTE: Dated: February 27, 2008 Increase state expenditures - $2,300/incarceration.

TFA supports although a class E felony is somewhat harsh - civil damages, including presumed harm and the ability to recover attorney's fees would be preferable. Class E felonies would mean people would loose their jobs and consequently almost no one will be prosecuted fully.



SB 3758
Norris CRIMINAL LAW: Increased penalty for possession of handguns. Creates Class E felony offense of possessing a handgun with a prior conviction for an offense designated as a Class A, B, or C felony. (HOUSE: HB 3714, DeBerry J.; Set for House Judiciary Criminal Practice Subcommittee 03/19/2008.) FISCAL NOTE: Dated: February 14, 2008 Increase state expenditures - $254,500/incarceration.

TFA opposes because the prior offense IS NOT limited to prior violent felonies. Also, the statute does not address the impact of whether the person has had a restoration of rights.

Authorizes person with handgun permit to carry handgun while hunting big game with a bow and arrow during the archery-only deer season. AMENDMENT: House Judiciary amendment 1 adds that any person hunting must wear orange as if gun hunting and cannot carry a legal hunting firearm. (SENATE: SB 0401, Kilby; Referred to Senate Environment, Conservation & Tourism.) FISCAL NOTE: Dated: February 11, 2007 Increase state expenditures - not significant/wildlife resources fund. TFA supports the idea BUT NOT the house amendment which provides as follows:

; provided, that any person authorized to carry a handgun pursuant to §39-17- 1351 may carry a handgun as defined in §39-11-106(16) while hunting big game with a bow and arrow during the archery-only deer season if such person:

(1) Wears at least five hundred (500) square inches of the daylight fluorescent orange color, as defined in §70-4-124)(b), on the upper portion of the body and head, visible from the front and back; and

(2) Carries no additional firearm legal for hunting deer as provided by the wildlife resources commission in its annual proclamation relative to the manner and means of hunting, taking and trapping.

SECTION 2. Tennessee Code Annotated, Section 70-4-123(b), is amended by adding the following language at the end of the subsection:

In addition, a person who violates the provisions of this section shall not be eligible to obtain a handgun carry permit as provided in §39-17-1351 for a period of two (2) years and, if such person currently holds a handgun carry permit, then the handgun carry permit held by such person shall be revoked for two (2) years.

What exactly is accomplished by allowing the carry of a handgun that could never be used for deer hunting? Most people interested in this change are wanting the handgun for protection from predators and humans - not to hunt.

Removes buckshot exceptions. AMENDMENT: Senate amendment 1, House Wildlife amendment 1 specifies that this bill applies regardless of any existing law or private act with contrary provisions. Bell ENVIRONMENT & NATURE: Possession of firearms in wildlife management areas. Allows person with a concealed carry permit to possess a firearm while traversing any public hunting areas, refuges, wildlife management areas, and national forests managed by the state. AMENDMENT: House Judiciary amendment 1, Senate amendment 1 rewrites the bill to substitute handgun carry permit for concealed carry permit for consistency with the code. House Finance Budget Subcommittee amendment 1, Senate amendment 2 clarifies that possession of handgun in wildlife management areas with handgun carry permit is only permitted in a vehicle on public roads, in parking lots, in common areas, on campgrounds, and within 20 feet of designated trails. Also specifies that handguns must not have scopes. Senate amendment 3 specifies that this bill authorizes any person who has a handgun carry permit to possess a handgun on public roads located in public hunting areas, refuges, wildlife management areas, and national forests managed by the state whether or not the person is in a vehicle. House Finance Budget Subcommittee amendment 2 adds language to include areas within 20 feet of river or stream. House Finance Budget Subcommittee amendment 3 changes effective date to July 1, 2008. (SENATE: SB 0053, Finney R.; Senate 04/16/2007 passed with amendments 1, 2 & 3.) FISCAL NOTE: Dated: January 31, 2008 On May 11, 2007 we issued a corrected fiscal note on this bill indicating a decrease in state revenue to the wildlife fund of less than $11,250 and a decrease in local government revenue of less than $13,750. These figures were based upon approximately 25 violations per year applicable to the provisions of the bill. Based upon new information that there may be fewer such violations, the estimated fiscal impact of this bill is: (CORRECTED) Decrease state revenue - $300/wildlife fund. Decrease local govt. revenue - $400.

Allows person with a handgun permit who is not consuming alcohol to carry handgun in restaurant where beer or alcoholic beverages are being served subject to provisions regarding the posting of notices on property. (SENATE: SB 0714, Stanley; Withdrawn in Senate 02/06/2008.) FISCAL NOTE: Dated: March 6, 2007 Decrease local govt. revenues - not significant. Decrease local govt. expenditures - not significant.

Vaughn CRIMINAL LAW: Handgun carry permits for certain hospitalized persons. Clarifies that people who have voluntarily been committed to a mental institution can apply for handgun carry permits after seven years while those who were involuntarily committed cannot. (SENATE: SB 3368, Beavers; Referred to Senate Judiciary.) FISCAL NOTE: Dated: February 6, 2008 Increase state expenditures - $3,300 / one-time.

DeBerry J. CRIMINAL LAW: Criminal offense involving display of "imitation firearm." Creates a new Class B misdemeanor offense of intentionally displaying or exposing an imitation firearm in a public place in a threatening manner, except in cases of justifiable defense. (SENATE: SB 2719, Norris; Senate passed 02/06/2008.) FISCAL NOTE: Dated: January 11, 2008 Increase state revenue - not significant. Increase state expenditures - not significant. Increases the mandatory minimum sentence for the commission of a dangerous felony while in possession of or employing a firearm; further increases mandatory minimum sentence for possessing or employing a firearm with a prior conviction for a dangerous felony. (SENATE: SB 3849, Stanley; Referred to Senate Judiciary.) FISCAL NOTE: Dated: March 3, 2008 Increase state expenditures - $8,108,100/incarceration.

TFA generally opposes increasing penalties on existing law on the premise that a higher penalty would be effective to reduce that category of crime.



HB 1875
McDonald CRIMINAL LAW: Hunting with a firearm and while under the influence. Creates a Class A misdemeanor for hunting with a firearm while under the influence of alcohol or any intoxicant, drug, or drug producing stimulant. Also creates a Class A misdemeanor for underage hunting with a firearm while under the influence of drugs or alcohol for those under the age of 21 years. AMENDMENT: Senate amendment 1 restricts the application of the bill to public land only. Senate amendment 2 inserts the words "public lands and public waters" in a third place in the bill for uniformity purposes. (SENATE: SB 1566, Herron; Senate 05/09/2007 passed with amendments 1 and 2.) FISCAL NOTE: Dated: April 3, 2007 Increase state revenues - Less than $100,000/Wildlife Fund. TFA STRONGLY OPPOSES - This staute is the one courts rely on to say that individuals who have restorations of rights are nonetheless unable to have a "full" restoration - including the ability to get a firearm - if the prior conviction was a violent felony and/or a felony drug offense.

Curtiss CRIMINAL LAW: Handgun possession penalties. Increases penalty for person possessing a handgun who has been convicted of a felony involving use or attempted use of force, violence, or a deadly weapon to Class C felony from Class E felony. Increases penalty for person possessing a handgun who has been convicted of felony drug offense to Class D felony from Class E felony. Creates Class E felony for person possessing a handgun who has been convicted of any other felony. (SENATE: SB 2865, Burchett; Referred to Senate Judiciary.) McCord CRIMINAL LAW: Possession of firearm where alcohol is served. Permits a person who has a permit to carry a handgun to carry gun in place where alcohol is served for consumption on premises if person not consuming alcohol or is not otherwise prohibited by posting provisions. Known as the "guns in bars" bill. (SENATE: SB 0023, Jackson; Senate passed 01/16/2008.) FISCAL NOTE: Dated: January 5, 2007 Decrease local govt. revenues - not significant. TFA supports. THIS IS THE PRIMARY RESTAURANT BILL IN 2008 It has already passed the SENATE

NOTE: There are efforts to amend the House version to put the 50% rule, etc., but these amendments MUST BE REJECTED BECAUSE THEY WILL KILL THE LEGISLATION.



HB 3868
Watson E. CRIMINAL LAW: Law enforcement to carry firearms where alcohol is served. Authorizes on-duty and off-duty law enforcement officers to carry weapons in establishments serving alcohol for on premises consumption. (SENATE: SB 3884, Ketron; Referred to Senate Judiciary.) FISCAL NOTE: Dated: February 12, 2008 Minimal.

TFA opposes in preference for a law allowing anyone legally possessing the firearm - TFA generally opposes class legislation.



HB 3622
Watson CRIMINAL LAW: Carrying of firearms by law enforcement officers. Removes provisions prohibiting law enforcement officer from carrying firearms in school without notifying the principal; in a place that serves alcohol for on-premises consumption; or in a court room except during course of official proceedings. (SENATE: SB 3853, Bunch; Referred to Senate Judiciary.) FISCAL NOTE: Dated: January 27, 2008 Decrease local gov't. revenue - not significant. Decrease local gov't. expenditures - not significant.

TFA opposes special legislation of this type. Current law already allows law enforcement possession in these places if the officer is in the "performance of his duties."

Bell ENVIRONMENT & NATURE: Possession of handguns in hunting areas and refuges. Authorizes persons with handgun carry permits to possess firearms in all public hunting areas, refuges, wildlife management areas, and (SENATE: SB 3662, Finney R.; Referred to Senate Judiciary.) DuBois JUDICIARY: Consequences of guilty pleas. Requires judge, when addressing a defendant who intends to plead guilty to a domestic violence offense, to advise the defendant prior to the plea that the plea will prevent the defendant from purchasing a firearm and affect such person's eligibility to apply for a handgun permit in the future. HB 3667
Niceley CRIMINAL LAW: Possession of handgun while in state park. Allows any resident, who has a valid handgun carry permit, to possess his or her handgun while within the boundaries of any state park. (SENATE: SB 3904, Burchett; Referred to Senate Judiciary.) FISCAL NOTE: Dated: February 29, 2008 Minimal.

HB 3046
Matheny CRIMINAL LAW: Application fee for handgun carry permits. Lowers initial application fee for handgun carry permits from $115 to $100. (SENATE: SB 3700, Roller; Referred to Senate Judiciary.) FISCAL NOTE: Dated: February 18, 2008 On February 5, 2008, we issued a fiscal note on this bill indicating a decrease of state revenue of $725,100 per year. Based on additional information received from the Department of Safety, the fiscal impact of this bill is estimated as follows: (CORRECTED) Decrease state revenue - $361,100 / earmarked to the department of safety for offsetting costs of the handgun carry permit program decrease state expenditures - $361,100 / department of safety reducing costs of the handgun carry permit program.
