What’s at stake in the Aug. 2 Election? Jim Harrell Events 6

Postby Pat McGarrity » Mon Jun 18, 2012 2:04 am

Jim Harrell is running in the Cordova area, District 96, where gun owners currently do not have any representation. That position is currently occupied by Rep. Steve McManus R-Cordova. Rep. McManus is a member of the House Calendar & Rules Committee.

Rep. McManus was one of the committee members that prevented the voice of the people from being heard by killing our Safe Commute bill in that committee. Because of this, there was, purposely and deceptively, no anti-gun vote on record. This bill had at least 30 co-sponsors. Even constituents opposed to Safe Commute were denied representation. This is outside the authority of that committee according to House rule 49:

The committee members that killed this bill also overstepped their authority in that this is not an area that the Tennessee Constitution:

http://www.capitol.tn.gov/about/docs/TN ... tution.pdf

authorizes the legislature to regulate. Evidently, Rep. McManus has either not read the constitution, did not understand it, or did not care. Article I, Section 26 states:

“That the citizens of this state have a right to keep and to bear arms for their common defense; but the Legislature shall have power, by law, to regulate the wearing of arms with a view to prevent crime.”

What does a bill regarding, lawful citizens, keeping a firearm in their vehicle for the lawful purpose of “their common defense” have to do with “the wearing of arms with a view to prevent crime”?

The politicians that participated in killing this bill campaigned for the job of “representative”; no one drafted them into it. They took an oath to uphold the constitution and refer to themselves as “public servants”. Those are not defined as doing whatever serves them politically, without regard to their action’s constitutionality or adherence to their own House rules. It should mean taking responsibility for their record, not hiding behind committee deceptions.

Because of liability fears, some large corporations demanded that Safe Commute be killed. This is in spite of the success in other states that respect the right of employees to travel to and from work with the ability to protect themselves. To make sure this was done, these corporations contributed large sums of money that grass roots groups, constituents and small businesses can't match.

The nurse working the night shift, nor the sever at a restaurant, can compete financially with these powerful lobbyists. Neither can the aircraft mechanic or even the pilot. The lobbyists know that their clients have enough attorneys on staff to wear down any surviving spouse who may try to replace the income that was lost with their loved one because they were denied the tools to protect themselves.

That’s what is at stake in the August 2nd election. Voters in District 96 have the opportunity to send a message that representation will no longer be for sale to the highest bidder in Tennessee.
