"Cease and Desist" Resolution

Postby oldsmobile98 » Fri Mar 13, 2009 10:05 am

I have a meeting with Senator Overbey next week in Nashville, and I am planning on asking him to introduce a bill in the TN General Assembly like those introduced in Idaho (HJM 003) and Michigan (HCR 009). It is basically an order for Congress to stop passing restrictive firearms legislation in general.

I might add something specifically against the "assault weapons ban".

I got this idea from the Second Amendment March forum, so thanks to them. The two threads and bill texts are here.

It is great that you are going to meet with Senator Overby. He was recently appointed to the Senate subcommittee on Firearms and Ammunition.

Be aware and review HJR0104 and HJR0108

HB1783 - which is the Firearms Freedom Act - http://wapp.capitol.tn.gov/apps/BillInf ... ber=HB1783

HB 1796 by *West ( *SB 1610 by *Beavers) which is another version of the Firearms Freedom Act - http://wapp.capitol.tn.gov/apps/BillInf ... ber=HB1783

HB 1924 by *Fincher ( *SB 1908 by *Jackson) enacts the "Second Amendment Protection Act" prohibiting the sale of microstamped firearms or ammunition in this state. http://wapp.capitol.tn.gov/apps/BillInf ... ber=HB1924

The addition of a clause about NFA weapons is more than fine with me... it's just not an area of the law that I know a whole lot about.

If anyone wants to take a shot at it, please go ahead.

Thanks.

There is an excellent argument to be made, particularly supported by the case law that exists before 1968, that NFA weapons are those primarily protected by the 2nd Amendment.

This is the first generation that has not been ENCOURAGED by the Federal government to own the standard military-issue individual weapon. There are many thousands of hidden machine guns in this country that have been brought back from overseas by veterans, built by curious tinkerers, and legally bought prior to the NFA but never registered. This has never been a problem to anyone except certain bureaucrats and politicians.

While I agree that politically it is important to appreciate every small gain we win towards freedom, I also understand that we have not truly gained freedom until we can walk into our favorite gun shop, plunk down cash, and walk out with a fully-operable Thompson, M16, MG3, or whatever you desire with no paperwork. We had that freedom prior to 1938. There is no logical reason we can't have it again.

Edit by Mod, it was in 1934 the NFA was passed. Good post though. SG
